What are the toy safety compliance and certificates?

Toy product certification and compliance can differ from one country to another.

In the US

For toys intended for children under 12 years old, it is mandatory to have a CPC (Children’s Product Certification). This certificate must be issued by third-party labs authorized by the CPSC (US Consumer Product Safety Commission) to verify that your toy products have passed CPSIA and ASTM F963 testing.

CPSIA (Consumer Product Safety Improvement Act) sets safety, product labeling, and testing requirements for toys imported into the US.

ASTM F963 is the US standard law for toy safety, applicable to toys used by children under 14 years old.

For electronic toys like RC cars, compliance with the FCC (Federal Communications Commission) is necessary. If toys emit radiation, they are subject to FDA (Food and Drug Administration) requirements.

In the Europe

Toys exported to Europe must comply with the Toy Safety Directive — EN 71 and bear a CE mark. If toys are exported to the UK, they require UKCA certification, in addition to compliance with the EN71 standard.

My advice is to keep an eye on designs, patterns, and icons on the toys, as lots of them have copyrights. Before selling, perform basic intellectual property checks:

Search product keywords & descriptions on Google to find patent or trademark numbers.

Check the official website of your country. Click U.S. Patent Search, and EU Patent Search for direct search if you’re in the 2 regions.

Note that patents still under review won’t appear in searches. For more specific details, consult a professional intellectual property lawyer.

3. Simple customizing in-stock toys

If you are simply adding your logo, custom packaging, or changing the color of a supplier’s in-stock toys, make sure to confirm whether these toys are originally designed by your supplier or are imitations/improvements of existing products. How to control the toy quality in China?

Before your toy products are shipped from China, you must hire 3rd-party inspection or sourcing companies to conduct product quality inspection. While 3rd-party inspections sound professional, their performance often leaves much to be desired because:

They don’t know the product and might not even know how to use it. So, they can only follow the checklist you provide, mechanically checking for common and obvious defects. They neither care about nor detect other product issues. The entire inspecting process is very rigid.

They don’t communicate with you in real time and only provide a final inspection report. If there are quality issues, you have to negotiate with your supplier for a solution. If you need another inspection, you have to pay again. This process is inefficient and costly.

If you sell products in European countries, you will find it required to affix the CE mark on products for legal sales. For many beginners to sell in the EU markets, they may not be quite clear about the regulations and directives of CE marking and whether their products are required for the marking or not.

What is CE Marking Meaning?

If you purchase products in the EEA, you will find the CE marking affixed on the products or their packages. Actually, this CE mark is just like the passport of these products for selling in the EU markets.

“CE” is short from the Origin French Conformité Européene, which means meeting European standards; the CE mark is the symbol of CE certification in accordance with European product regulations and standards. It’s a mandatory mark affixed on products when they enter the EU markets for sales.

As mentioned above, the CE mark is a mandatory mark used within the EU markets. But a special political event—Brexit, changes the application area of this mark.

Before Brexit

All the countries and districts of the EU apply the CE marking directives and require the CE mark on products uniformly, including the UK markets. And this mark is mandatorily required for most categories of products.

After Brexit

On January 30th, 2020, Britain officially exited the European Union. After that, many rules and regulations of the EU no longer apply to Britain, which includes the CE marking.

Meanwhile, other countries and districts in the EU area are still required to use the CE mark on products.

But it does not mean products on the UK market will not require any product mark anymore. Instead, the UK government introduced a new policy of the UKCA mark to replace the CE mark.

If your products are manufactured and placed on the EU market, the CE mark is still required for it. But if you want to sell it on the UK market as well, you have to affix another UKCA mark on your products.

The new mark has come into official use since Jan 1st, 2021. But due to many existing products on the market already affixed with the CE mark, the UK government decided to extend its usage until 31st Dec 2022.

After that time, all the products sold in the UK markets should be affixed with the UKCA mark. However, the UK government introduced special regulations for using the marks: the CE mark can still be used in Northern Ireland, and the other three districts (England, Scotland and Wales) should use the UKCA mark.

Actually, both UKCA and CE marks play the same role for products, just applied in different areas and markets. The product categories, technical requirements and conformity assessment procedures of the two marks are the same.

What're CE Marking Requirements?

CE making has been available in the EEA markets since 1993 (nearly 30 countries). It is applied to products imported from countries outside the EU, like China, and also products manufactured within EU countries.

For example, when you buy a phone or a light in the EU markets, you can find the CE mark on these products. Without the mark, it means this phone or light is not reliable enough.

As for concrete CE marking requirements, the mark “CE” on products is required to be visible, legible and indelible. Also, the two letters should be clear in accordance with the required size (unless the product category has different requirements).

What Products Require CE Mark?

The CE marking is the “passport” of products sold in the EU markets. But there are various categories and types of products like medical devices, so not all the products are required to affix the mark strictly.

The UK Conformity Assessment marking, also UKCA marking, refers to the new product mark required to affix on certain products sold in the UK in accordance with the new regulations of product certification.

After Brexit, the UK Government introduced the new UKCA declaration of conformity to replace CE certification and the UKCA marking will replace CE marking used for products sold in the UK market (covering England, Scotland and Wales) from 1st Jan 2022.

What is the FCC?

Before knowing what the FCC certification is, you should learn about the FCC.

FCC stands for the Federal Communications Commission, an official subsidiary organ of the United States federal government. How to Make FCC Testing and Obtain FCC Certification?

After the definition of FCC and FCC certification, you must want to know the concrete process of getting the certification. Before the certification process, you need to be clear about FCC testing types.

Generally, FCC compliance testing is mainly divided by product type and some are named the following for your reference:

  • FCC Part 15 and FCC Part 18 (the most widely used),

Two Types of FCC Certifications with Concrete Processes

Then you need to make sure which type of FCC certification is required for your products.
Before, FCC certifications included three types:

  • FCC ID,
  • FCC VoC (Verification of Conformity),
  • FCC DoC (Declaration of Conformity),

But since November 2nd, 2018, FCC SDoC (Supplier’s Declaration of Conformity) replaced FCC DoC and VoC to make certifications, in order to simplify the FCC certification process and clarify the usage specification of RFID (radio frequency identification).

FCC ID is mainly certificated for wireless products, and FCC SDoC certificates for general products without wireless functions, so requirements for each type are different.

FCC ID Certification

As I mentioned above, FCC ID certification applies to wireless products to test EMC (electromagnetic compatibility) and RF (radio frequency), like Bluetooth headsets, and smart face slimmers.

There are two methods for you to apply for an FCC ID certification:

1. Send products to FCC-TCB directly, but it costs a lot with unpredictable time.
2. Select the third-party institution authorized by FCC to test products and send materials to TCB for issuing certificates.

The first choice is not advisable, and we will list the process of the second method in the following part.

If you’re applying for the FCC ID for the first time, you should register an FCC-FRN to create profiles and apply for a permanent grantee code, and the cost of this code is $60.

Then you can check your FCC ID on the FCC official website:

Undoubtedly, you cannot test the product on your own, so you need to select a reliable test institution or a laboratory authorized by FCC to finish FCC testing.

When waiting for FCC approval to send the grantee code to you, you need to send product samples with documents and files to the institution or laboratory for testing your products. Then the institution will provide a test report for you.

When testing and getting test reports from the institution, you need to submit all product documents with test reports to TCBs (Telecommunication Certification Bodies) appointed by FCC, waiting for TCBs to audit.

Don’t forget to prepare the following:

  • Application form of FCC certification
  • FCC ID label and label location
  • Photos of product details (internal and external)
  • Product introduction
  • Block diagram
  • Schematic diagram
  • Operation theory
  • Test reports

After confirmation, TCBs (getting FCC approval) will issue the certifications and then you can get the certificates within several weeks.

If your products are not equipped with wireless functions, you just need to obtain FCC SDoC certifications.

Different from FCC ID, SDoC requires you that the responsible party for your products and their mailing address as well as email address are in the USA to test the products. It means only USA companies can issue SDoC statements, while non-United State companies (including manufacturers and laboratories) cannot.

When products are exported to the USA, customs will require you to provide FCC SDoC statements based on the laws and regulations in the clearance process. Online platforms, like Amazon, will also require sellers to upload FCC SDoC statements.

Each regulation mentioned in 24 CE directives gives you legal requirements and compliance necessary for CE marking. These points are formally called ‘Essential Requirements’ in the directive’s list. These essential requirements are pretty general. These basic requirements do not give you details regarding designing a product to meet the demands.

Third-Party Assessment

Some directives in the list require your product to be assessed, tested, and certified by a third party. This means if a third-party organization approves your product, it will ensure conformity with the applicable essential requirement. 

In Europe, these organizations are commonly called Notified Bodies (NB). If a critical need does not outline any third-party assessment, then you can rely on your in-house assessment facilities for conformity. Some of the directives make it mandatory for the manufacturer to get their products assessed by NB. T

hese directives include the equipment and protective systems, medical devices directives, pressure equipment directives, the simple pressure vessels directives, and the burning fuels directives. Other given demands do not need a manufacturer to assess NB if they comply with harmonized standards. 

The EU has recently reduced the list of products that need NB certification. For instance, the low voltage directives no longer need NB assessment. The EC is now putting more onus on the manufacturers to make their products compliant by themselves.

Assess product conformity

To assess the conformity of your product, you have to test and document the product’s agreement with the directives. 

Along with each order given is the conformity assessment procedure, which also refers to modules. With the list of demands, there are 08 assessment modules for conformity. The modules are Internal Production Control, Conformity Type, EC Type Examination, Production Quality Assurance, Product Verification, Product Quality Assurance, Unit Verification, and Full Quality Assurance.

Different activities involve directives for CE marking for conformity assessment, including visual inspection, product testing, review of products label and instructions, and risk analysis. In addition, many regulations allow you to choose from various procedures of assessment for the same product. Knowing your options for conformity may save you money and time.

Technical Documents

CE directives make it mandatory for the manufacturer to create and maintain technical documentation regarding the conformity of the product with the relevant directives. 

It is the EC requirement to keep the documentation pertinent to the CE-marked development for at least ten years from the date of manufacturing. The enforcement authorities often ask for the technical file/documentation within short timelines.

Therefore, it is essential to keep the technical documentation updated, especially in modifying the product. It is necessary to keep in mind; several CE directives require the technical documentation to be translated into the country’s official languages in which they are sold.

Conformity Declaration and Affixing of CE Mark

The document outlining and certifying all relevant compliance of a product with CE directives is called the Declaration of Conformity. It is an acknowledgment by the product manufacturer that they have successfully met all the applicable essential requirements given in CE directives. 

This declaration is checked at the point of entry of the EU by the authorities. The order of conformity is a one-page document that states, who you are, details of the product, directives involved, used standards, test results, and the name of the authorized/responsible person in your company.

All the products moved within the EU must be affixed with CE Mark, no matter if they are manufactured in any country outside the EU or the EU member states. The CE mark on the product is proof of compliance with all the relevant directives of the EC. Sometimes with the CE Mark, the identification number of NB is also given for reference.
